Legal hold is a part of the eDiscovery process undertaken in response to actual or prospective litigation. For information on how to leverage the Code42 platform for eDiscovery, see our eDiscovery Integration Guide.
This article explains how to use the Legal Hold web app to place users' backup data on legal hold.
Step 1: Create a preservation policy
Considerations when upgrading:
- Preservation policies and matters: When you upgrade to Code42 server version 6.x or later, any existing legal holds are migrated to separate matters and preservation policies. For example, one legal hold created before 6.x becomes one matter and one policy when you upgrade to 6.x or later.
- Known issue: If you created a preservation policy with the default settings in version 5.x of the Legal Hold web app, the Remove deleted files setting is not applied properly. We recommend upgrading to version 6.0.4 or later to ensure all existing preservation policies apply settings correctly. Preservation policies created in version 6.0.x or later are not affected.
The preservation policy defines which files are included in the legal hold and how long to keep files under legal hold. Create a preservation policy that you can apply to different matters.

Step 2: Create a matter
In the Code42 Legal Hold web app, a matter is the collection of all the custodians and backup data associated with a litigation. To put backup data on legal hold, create a matter, apply a preservation policy, and add custodians. Learn more about how to create and manage a matter.
